During a Crew call that occurred in early Feb, 2023 a member asked when the next Executive Board Election would occur. The answer given by President Paulsen and Vice-President Knox was 2024. Secretary Grable confirmed the same by Email that the next election would be held in accordance with the IBT Constitution and Local Union 2750 Bylaws in 2024. On February 13th, Pete Tanner posted a letter to IBT General President Sean O'Brien regarding scheduling of an Election in connection with the release from trusteeship.
IBT General President Sean O'Brien agreed with Pete Tanner and informed the Local E-board that an election needed to be held in 2023. President Paulsen then informed the membership via News Wire 149 dated March 17th "As mentioned in the crew call yesterday, we will be holding union elections for the Executive Board and Stewards this fall. Additional information on the election process and important dates will be provided around the third quarter as the election gets closer."
On August 25, 2023 prior to the Election schedule being published a letter requesting a (60) day period for the upcoming election was Sent to the 2750 Executive Board President Captain Yngve Paulsen.

On August 29, 2023 after the Election schedule was published another request was made in writing.

On September 13, 2023 a letter was sent to the US Dept of Labor.
The US Department of Labor could not intervene due to a 90-day window requirement prior to the Election for plaintiffs to exhaust all available local remedies. Despite being informed by IBT General President Sean O'Brien in February that an Election must be held in 2023, the E-board decided to wait six months. They officially announced the Election schedule on August 28th, with the process set to begin around October 17th, making it impossible to meet the 90-day requirement imposed by the US Department of Labor.

On November 17, 2023 an Election Protest was timely filed with Joint Council #26.
Section 17 (G.2) of the Bylaws: Election Protests
(2) In the event there shall be any protest or charge by any member concerning the conduct of the election after the election has been held, such protest or charge shall be made in writing by such member within seventy-two (72) hours setting forth the exact nature and specifications of the protest and his claim as to how it has affected the outcome of the election. Such protest or charge shall be made to the Secretary-Treasurer of the Joint
Council, or State Conference, if there is no Joint Council, with which the Local Union is affiliated and the protest or charge shall be referred to the Executive Board for disposition. The decision of the Executive Board shall be appealable to the General
Executive Board for final decision, which is not appealable to the
Convention.
